1. Acceptance of Terms

By accessing or using Kode ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Kode. We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

Kode is a no-code app builder platform that allows users to create functional web applications by describing what they want in natural language. The Service uses artificial intelligence to generate application code, provides a visual editor for customization, and offers hosting and deployment capabilities. Features may change over time as we improve and expand the platform.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

Kode offers subscription plans that include credits for AI generation and other platform features. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

• Credits are allocated based on your subscription tier and may expire at the end of each billing cycle unless otherwise stated.
• Unused credits do not roll over between billing periods unless your plan explicitly allows it.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refund policy: If you are unsatisfied with the Service, contact us at support@meetkode.com within 7 days of your purchase for refund consideration. Refunds are evaluated on a case-by-case basis.

5. User Content

You retain full ownership of the applications, designs, and content you create using Kode. We do not claim any intellectual property rights over your generated apps or content. By using the Service, you grant Kode a limited license to host, display, and transmit your content solely for the purpose of operating and providing the Service. You are solely responsible for the content you create and must ensure it does not violate any applicable laws or third-party rights.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Generate or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other user accounts, or related systems or networks.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Use the Service to build applications that facilitate illegal activities, fraud, or deception.
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.

7. Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your account and associated data after a reasonable retention period following termination. You may terminate your account at any time by contacting us or using the account settings in the Service.
